Sose Mayilyan is a PhD student at the School of Law and Government, Dublin City University. Having a background in European and International Law, she worked and conducted research in Armenia and Denmark in the area of EU law, as well as in the fields of foreign policy and international human rights.

Thesis Title:

EU Free Movement of Persons and Social Benefits: The Influence of Socio-Legal and Political Factors

Thesis Abstract:

The topic of my research is the free movement of persons in the European Union and the access of EU citizens to social benefits. The research aims to discover the impact social and political factors have on the regulation of free movement of persons and social benefits in the EU legislation, as well as in the case law of the Court of Justice of the European Union.

Throughout the years the case law of the EU Court of Justice with regard to the mentioned issues has undergone certain changes, which gives rise to the question of why the Court has changed its position in this regard. Moreover, another question arises as to how and in what direction its approach has changed. In addition, it is important to consider what influences these legal developments and what role social changes and political dynamics play in this evolution.

The issue of free movement of EU citizens within the Union has been covered in the academic literature rather extensively, and from various aspects, inter alia, social welfare. Nonetheless, it is important to address in detail the question of what factors affect the regulation of the free movement of persons in relation to access to social assistance, as well as to provide the consideration of the process of Brexit, one of the main political phenomena affecting the regulation of the issues in question.
